Privacy policy and protection of personal data

The protection of privacy is a major security issue and APG-e-Tech would like to pay particular attention to the processing of your personal data. So that you can use our services with confidence, this Privacy Policy aims to transparently describe what data is processed by APG-e-Tech, how and why.

APG-e-Tech undertakes to comply with all its obligations resulting from the regulations applicable to the processing(s) of personal data, especially:

– Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 applicable since 25 May 2018 (hereinafter the “European Data Protection Regulation” or “GDPR”)
– the French Data Protection Act no. 78-17 of 6 January 1978 as amended.

I. Object

The purpose of the Privacy and Data Protection Policy is to inform you in a transparent manner about the type of personal data we collect, their processing and your rights.
When APG-e-Tech collects your personal data, this collection is carried out in a fair and transparent manner through the presence of information mentions, collection of consent (check box) or reference to this Policy. Once you give your consent, you have the option to withdraw it at any time.
The personal data we collect or hold about you is strictly necessary for our business.

II. Definitions

Personal data: any information relating to an identified natural person or that can be identified directly or indirectly by an identification element such as a name, telephone number, postal address, e-addressmail, IP address, identification number, location data, etc.
Processing of personal data: any operation carried out on personal data such as collection, registration, organization, retention, adaptation, modification, extraction, consultation, use, interconnection, limitation, erasure, destruction, etc.
Data controller: the natural or legal person, public or private, or the service, who determines, alone or with others, the purposes and means of processing.
Subcontractor: the natural or legal person, public or private, or the service that processes personal data on behalf of the controller.

III. Origin of the data

APG-e-Tech may be required to collect and process your personal data in the following cases:  

1) When browsing our website:

– When you decide to contact us by phone, email, online contact form or if you request an online quote through the tools on the site, we collect identity and contact data to which we associate a reference. This information is mandatory to process your application. Otherwise, it may not be processed or its processing delayed.

– We may collect information when you browse our social media pages. The personal data that you deposit on our pages and accounts of our social networks are retrieved by APG.e-Tech in particular to carry out loyalty, study, analysis, survey and promotion actions. Publications, notices and comments on our products, services or content may be saved and used.

2) When using our mobile apps:

When you use our mobile applications (IOS and Androïd) we may collect certain personal data in order to allow you to use the application. These are primarily your names and phone numbers. Your phone number will be used to send an OTP (One Time Password) security key, which is a strong authentication tool allowing us to secure your account/access. Your email address may also be collected. Phone and mail will be used to send you informative messages and notifications.

3) When applying for an offer on our website:

We collect data relating to your marital status, your contact details, your CV, your cover letter and any additional data necessary for the analysis of your application file.

IV. Use of your data

Based on the performance of the contract between us, we use your data to provide you with our services, including:
– ensure the creation and management of your Account;
– provide you with our services;
– send you push notifications and emails about your use of our services;
– answer your questions to customer support;
– allow you to share on social networks.

In accordance with the regulations in force and subject to your acceptance, we may use your personal data (only those necessary in the context of our activity) to implement communications campaigns for commercial or marketing purposes by electronic means (e-mail, mobile alerts, SMS, notifications in the application) in order to offer you new services, exceptional or exclusive offers that may interest you. You can let us know at any time that you no longer wish to receive these commercial communications.

V. Subcontractors and recipients of data

All your personal data that has been collected by APG-e-Tech is strictly confidential. APG-e-Tech will never transmit your personal data to any third party who may use it for commercial and/or direct advertising purposes, without your express consent. Our employees and partners are bound by the confidentiality of the data they process.

APG-e-Tech may be required to securely transfer to third parties certain personal data that are necessary, in particular, in connection with the execution of a contract between you and APG-e-Tech. In this case, our partners and/or sub-partnersprocessors who may have access to your data, will process them on our behalf, according to our instructions, in compliance with this Privacy Policy and applicable regulations.

VI. Data controller

APG-e-Tech, registered with the Ajaccio RCS under number 889 912 226 with its registered office Rue René Biancarelli – 20137 Porto-Vecchio, represented by Mr.Alexandre Cadre in his capacity as President, is responsible for the processing of the data it collects as part of your use of APG-e-Tech services.

VII. Data retention period

Personal data relating to customers and prospects shall not be stored beyond the period strictly necessary for the management of the business relationship. This retention period is variable and depends on the nature of the data and the purposes pursued. At the end and taking into account any legal or regulatory obligations to keep certain data, we delete or anonymize your data.

The data collected on the online contact forms will be kept for a period of three (3) years from the day of their collection by the controller or the last contact from the prospect, unless otherwise required by law.

The lifespan of cookies or other tracers deposited and read for example when consulting a website is thirteen (13) months maximum.

In the case of an application, the retention period for the CV and cover letter is twenty-four (24) months. Only authorised persons may access your data for strictly internal purposes.

VIII. Exercise of rights

APG.e-Tech makes every effort to ensure the security, integrity and confidentiality of your data.

You can exercise rights relating to all data concerning you. The rights attached to your personal data are the following:
Right of access: this is your right to obtain confirmation that your data is processed or not, and if so, to access this data.
Right of rectification: this is your right to have your inaccurate data held by APG.e-Tech rectified as soon as possible, and your incomplete data completed.
Right of deletion/erasure: this is your right to obtain, as soon as possible, the erasure of your data held by APG.e-Tech, subject to our legal obligations of retention.
Right of limitation: this is your right to obtain the limitation of the processing when you object to it, when you contest the accuracy of your data, when you think that their processing is unlawful, or when you need it for the purpose of finding, exercising or defending your legal rights.
Right to object: You may object to the processing of your personal data for your own reasons. You have the right to object at any time to your data being used for profiling purposes if this profiling is linked to automated decision-making or if the processing of your personal data is used for commercial prospecting purposes notably by telephone.
Right to portability: this is your right to receive your data in a structured, commonly used, machine-readable and interoperable format, and to transmit it to another controller without us impeding it.
Complaints: You have the right to lodge a complaint with a supervisory authority.
Instructions in case of death: you have the right to give instructions for the fate of your personal data in case of death.

In order to guarantee the confidentiality of the data, you may be asked to provide us with a photocopy of an identity document/identity document containing your signature. APG-e-Tech will respond within one month of receipt of the request and, if necessary, this period may be extended by two months. You will then be informed of this extension and the reasons for the extension within one month of receipt of the request.

If you do not wish to be the subject of commercial prospection by telephone, you can register for free on the list of opposition to telephone canvassing provided for in article L223-1 of the Consumer Code directly on the website www.bloctel.gouv.fr/ or by mail addressed to: Société OPPOSETEL, Service BLOCTEL – 6, rue Nicolas Siret – 10 000 Troyes. However, despite this registration, we can contact you by telephone if there are contractual relations in progress unless you object to it or if you object to it during the call.
